These Terms and Conditions of Use ("Terms") govern your access to and use of the website www.taxfetchindia.com (hereinafter referred to as the "Platform"), operated by TaxFetch India, a Proprietorship firm based in Pune, Maharashtra, India (hereinafter referred to as "TaxFetch India", "we", "us", or "our").

These Terms are an electronic record in terms of the Information Technology Act, 2000 ("IT Act") and rules thereunder, as applicable and as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

These Terms are published in accordance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, framed under the IT Act, that require publishing the terms of services and practices for access or usage of the Platform and Services.

These Terms constitute a binding and legally enforceable contract between TaxFetch India and you (the "User") under the Indian Contract Act, 1872. By accessing, browsing, or using the Platform or availing any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms along with our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Platform.

TaxFetch India is an online tax tools platform that provides six (6) free, online, browser-based tools designed to assist Indian taxpayers with tax-related calculations and information retrieval. All tools are provided free of charge.

3.1 TDS Fetch (Form 26AS)

The TDS Fetch tool enables users to retrieve their Form 26AS (Tax Credit Statement) from the Income Tax e-filing portal. This tool uses an automated browser to access the Income Tax e-filing portal on the user's behalf, with the user's express consent and using credentials provided by the user. The tool accesses the user's PAN-linked tax credit statement and presents it in a readable format. The user's PAN is stored securely in our database only for these purposes, handled in compliance with applicable data protection laws, and never used for unauthorized activities.

3.2 Smart Income Tax Calculator (AI-Powered)

The Smart Income Tax Calculator (AI-Powered) allows users to estimate their income tax liability under both the old and new tax regimes as per the prevailing provisions of the Income-tax Act, 1961. The calculations are based on the income details and deduction information provided by the user and are for informational purposes only.

3.3 HRA Calculator

The HRA Calculator helps users compute the House Rent Allowance (HRA) exemption available under Section 10(13A) of the Income-tax Act, 1961. The exemption amount is calculated based on the salary details, rent paid, and city of residence provided by the user.

3.4 Stock Trading Profit Classifier

The Stock Trading Profit Classifier assists users in classifying their stock trading profits as either business income or capital gains, based on the trading pattern and holding period information provided by the user. This classification is indicative and for informational purposes only.

3.5 Capital Gain Calculator

The Capital Gain Calculator helps users compute capital gains or losses arising from the sale of capital assets such as equity shares, mutual funds, property, and other assets. The calculations factor in the cost of acquisition, sale price, holding period, and applicable indexation benefits.

3.6 Bank Statement Analyzer

The Bank Statement Analyzer allows users to upload their bank statement PDF files for analysis. The tool processes the uploaded PDF to provide insights, categorization of transactions, and summaries. Bank statements are processed locally and are not permanently stored on our servers. The uploaded files are used solely for the purpose of analysis during the user's session.

You shall not use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.

6. Intellectual Property

6.1 Ownership

All Content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software code, user interface designs, tool algorithms, branding elements, and the overall design and arrangement of the Platform, is the exclusive property of TaxFetch India and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India and international treaties.

Subject to your compliance with these Terms, TaxFetch India grants you a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to access and use the Platform and Services solely for your personal, non-commercial use. This license does not include the right to:

7. Disclaimer of Warranties

PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS THE LIABILITY OF TAXFETCH INDIA.

7.1 The Platform and all Services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

7.2 TaxFetch India is NOT a Chartered Accountant firm, Certified Public Accountant firm, tax advisory firm, financial advisory firm, or legal advisory firm. The tools and Services provided on the Platform do not constitute professional financial advice, tax advice, legal advice, investment advice, or any other form of professional advice.

7.3 The tools and Services are not a substitute for the services of a qualified Chartered Accountant, tax advisor, financial planner, or legal professional. Users are strongly advised to consult with a qualified professional before making any tax filing decisions, financial decisions, or legal decisions based on the results or information obtained from the Platform.

7.4 TaxFetch India makes no guarantee or warranty as to the accuracy, completeness, reliability, or correctness of any calculations, results, classifications, or outputs generated by the tools on the Platform. Tax laws, rules, rates, and regulations are subject to frequent changes, and while we make reasonable efforts to keep our tools updated, we do not warrant that the tools reflect the most current legal provisions at all times.

7.5 The TDS Fetch tool relies on the availability and proper functioning of the Income Tax e-filing portal, which is a third-party government service. TaxFetch India makes no warranty regarding the availability, uptime, performance, or accuracy of the Income Tax e-filing portal. The functioning of the TDS Fetch tool is dependent on the Income Tax portal's availability, structure, and interface, which may change without notice.

7.6 TaxFetch India is not responsible for any errors in tax filing, incorrect tax calculations, missed deductions, or any financial loss that may arise from reliance on the results or information obtained from the Platform. Users should independently verify all calculations and results before using them for tax filing or any other purpose.

8. Limitation of Liability

8.1 To the maximum extent permitted by applicable law, TaxFetch India, its proprietor, employees, agents, licensors, and service providers shall NOT be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with:

8.2 The maximum aggregate liability of TaxFetch India arising out of or in connection with these Terms, the Platform, or the Services, regardless of the cause of action or the theory of liability, shall be limited to the amount actually paid by you to TaxFetch India for the Services during the twelve (12) months preceding the event giving rise to the claim. As all tools on the Platform are currently provided free of charge, this maximum liability amount is zero (₹0).

8.3 The limitations of liability set forth in this Section shall apply regardless of whether TaxFetch India has been advised of the possibility of such damages and regardless of the failure of essential purpose of any limited remedy.

9. Indemnification

You agree to defend, indemnify, and hold harmless TaxFetch India, its proprietor, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees and legal costs) arising from or in connection with:

10.1 Your use of the Platform is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Platform, you consent to the collection, use, storage, and processing of your information as described in the Privacy Policy, in compliance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

11. Third-Party Services

11.1 The TDS Fetch tool interacts with the Income Tax e-filing portal, which is an official government service operated by the Income Tax Department, Government of India. TaxFetch India is not affiliated with, endorsed by, sponsored by, or in any way officially connected with the Income Tax Department of India, the Central Board of Direct Taxes (CBDT), or the Government of India.

11.2 TaxFetch India accesses the Income Tax e-filing portal on the user's behalf, using the credentials and consent provided by the user, solely for the purpose of retrieving the user's tax credit information (Form 26AS). TaxFetch India does not have any control over the Income Tax portal's availability, functionality, policies, or data.

11.3 The Platform uses Google Analytics, a web analytics service provided by Google LLC, for the purpose of analyzing website traffic and usage patterns. Google Analytics may collect certain information about your use of the Platform through cookies and similar technologies. For more information about Google Analytics and its data practices, please refer to Google's Privacy Policy.

11.4 TaxFetch India is not responsible for the content, privacy policies, practices, or availability of any third-party services, websites, or resources. Your use of any third-party services is at your own risk and subject to the terms and conditions of such third-party services.

12. Service Modifications & Termination

12.1 Modifications

TaxFetch India reserves the right, at its sole discretion, to modify, update, suspend, or discontinue the Platform or any of the Services (or any part or feature thereof), temporarily or permanently, at any time and without prior notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform or Services.

12.2 Termination by TaxFetch India

TaxFetch India reserves the right to terminate or suspend your access to the Platform and Services, without prior notice or liability, for any reason, including but not limited to:

Upon termination of your access to the Platform, your right to use the Platform and Services shall immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

TaxFetch India reserves the right to modify or amend these Terms at any time. Any changes to the Terms will be effective upon posting the revised Terms on the Platform with an updated "Last Updated" date. TaxFetch India shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to:

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Indian Contract Act, 1872, the Copyright Act, 1957, the Digital Personal Data Protection Act, 2023, and all other applicable laws and regulations of India, without regard to any conflict of law principles.

14.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or in connection with these Terms, the Platform, or the Services ("Dispute"), the Parties shall first attempt to resolve the Dispute through good-faith negotiation for a period of thirty (30) days from the date of written notice of the Dispute.

14.3 Arbitration

If the Dispute is not resolved through negotiation within the aforesaid period, the Dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time). The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties. The seat and venue of arbitration shall be Pune, Maharashtra, India. The language of the arbitration shall be English. The arbitration award shall be final and binding on both Parties.

14.4 Jurisdiction

Subject to the arbitration clause above, any legal action or proceeding arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India. By using the Platform, you irrevocably consent to the exclusive jurisdiction and venue of such courts.

15. Severability

If any provision of these Terms is found by a court of competent jurisdiction or an arbitral tribunal to be invalid, illegal, or unenforceable, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable, while preserving its original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices, policies, or guidelines published by TaxFetch India on the Platform, constitute the entire agreement between you and TaxFetch India concerning the subject matter hereof and supersede all prior or contemporaneous communications, proposals, agreements, and understandings, whether oral or written, between you and TaxFetch India with respect to the Platform and Services.

No waiver by TaxFetch India of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by TaxFetch India to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Grievance Redressal

The Grievance Officer shall acknowledge receipt of your complaint within twenty-four (24) hours and shall endeavour to resolve the complaint within fifteen (15) days from the date of receipt, in accordance with the timelines prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

You may also report any content or activity on the Platform that you believe violates these Terms, applicable laws, or the rights of any person by writing to the Grievance Officer at the above email address.
